Terms and Conditions
of Katies-World.com / Ice Blue Concepts, L.L.C.
Before you can join, you must read and agree to these terms and
conditions. By joining this site, you are agreeing to these terms
and conditions, and are agreeing to be legally bound by them. This agreement
is subject to change by Katies-World.com / Ice Blue Concepts, L.L.C. at
any time. Changes are effective without notice upon each Subscriber.
NOTICE:
The sharing of your UserID and Password is strictly prohibited. We have
software in place to combat this. If you are caught sharing your UserID
and Password, you will receive a warning. If you continue to share, your
UserID and Password WILL be terminated. Your card will continue to be
billed until you cancel your membership.
1. Legal definitions
Hearby, the term "Member" or "Membership", as referred
to in this document shall mean -The Subscriber or User of a valid username
and password (User Id) for the Site during the term of membership.
Hearby, the term "Site", as referred to in this document shall
mean - The site which you are purchasing a username and password (UserID)
from Katies-World.com / Ice Blue Concepts, L.L.C. in order to access membership
areas and its materials and benefits of membership.
Hearby ,the term "Subscriber", as referred to in this document
shall mean - The End-user, Consumer, of the services of the Site and holder
of a valid username and password (UserID) for the Site.
Hearby , the term "UserId", as referred to in this document
shall mean - The combination of unique username and password that is sold
by Katies-World.com / Ice Blue Concepts, L.L.C. and used to access the
Site. A UserID is a license to use the Site for a period of time which
is specified.
Hearby , the term "Bookmarking", as referred to in is document
shall mean - The act of placing a URL into a temporary file on the Subscribers'
browser so that the subscriber may return to that page at a future date
directly, without passing through any pages that may have been precedent.
2. Description of services
Katies-World.com / Ice Blue Concepts, L.L.C. will provide one user id
to access the membership portion of the site and its contents for which
you are purchasing membership. Understand that while Katies-World.com
is an ADULT-oriented web site, it is also a NON-NUDE web site - there
is no guaranteed nudity associated with this membership, and it should
not be expected nor requested. Please keep in mind that the webcam area
contains live, real time performances - any visible nudity is accidental,
and the Subscriber should only sign up at his/her own risk. If you are
not of age to view nudity in your area (18 in most areas of the United
States), you should not sign up for the webcam area, as accidental nudity
is a possibility (but once again not to be expected, and certainly not
guaranteed). This site meets all US Code 2257 requirements/18
U.S.C. Section 2257 Compliance Notices. All records required
to be maintained are available upon request, via the Custodian of Records
(address below).
While taking advantage
of the services offered, it should be noted that the use of profanity
and/or demeaning text or tones towards Katie, or any other user of the
service will NOT be tolerated. Logging in to a chat session using a name other than your username will warrant you being kicked & banned from the current chat sesion. We are enacting a zero-tolerance rule on
this, and reserve the right to kick, or kick and ban you from the chat
area without prior warning being given. If any mention is made during the course of any live chat session as to the full identity, whereabouts or any personal information regarding Katie, the right is reserved to remove the customer from the chat session and further limit his/her access to the web site. We also reserve the right to disable
your account, and if necessary delete your membership altogether. The
posting of webcam images (captured or archived) is strictly prohibited.
Archived webcam images will be available for one month from the posted
date.
3. Billing
"Ice Blue Concepts, L. L. C.," parent company of Katies-World.com,
will appear on your credit card billing statement for all charges made.
By joining, you agree that you are the rightful cardholder of the credit
card being used, or you have permission of the rightful cardholder.
4. Payment/Fee
Sites will have periodic subscription fees that are defined by the
terms of the site at the time of the initial enrollment for subscription.
The member is responsible for such fees according to the terms of the
site, and subscription fees are non-refundable.
5. AUTOMATIC Recurring
Billing
As determined by the Webmaster of the site, subscription fees are to be
automatically renewed at the end of the original term selected, for a
similar period of time, unless notice is received from the Subscriber
seven (7) days prior to renewal. Webcam memberships obtained via credit
card and online check are on a 30 day billing cycle. Unless and until this agreement is
canceled in accordance with the terms hereof, Subscriber hereby authorizes
Ice Blue Concepts, L.L.C. to charge subscriber's credit card to pay for
the ongoing cost of membership. Membership is on a monthly basis (two month minimum), and
your card will continue to be charged once per month until you cancel.
In the event that a credit card is declined, Subscriber hereby authorizes
Ice Blue Concepts, L.L.C. to continue billing attempts until subscription
funds are obtained, regardless of card declination date (at current posted or discounted rates). Billing information will remain on file unless A). Cardholder has requested a membership be cancelled and expired accounts have been purged, or B). Cardholder specifically requests billing information be deleted from the billing system. ALL subscriptions require a two month minimum membership term. Basic memberships begin at $6.95, rebilling at $6.95/month if signed up before September 11, 2008, and $13.90 for the first month and rebilling at $9.95/month thereafter. Streaming memberships begin at $23.95/month, rebilling at $23.95/month if you signed up before October 15, 2004 and rebilling at $19.95/month if you signed up after October 15, 2004. Any reduced rate membership offer falls within the two month minimum membership terms, and applies to all customers rejoining the site www.katies-world.com. At no time
may Ice Blue Concepts, L.L.C. raise a subscription price on an existing membership without prior consent from customer. If member chooses to cancel prior to the second month being charged, the second month will be charged and rebilling will be halted after that time. All KWMobile memberships will rebill at $3/month until termination service request is received.
6. Cancellation
At any time, and without cause, subscription to the Service may be terminated
by Katies-World.com / Ice Blue Concepts, L.L.C. upon notification of the
other by electronic or conventional mail, or by telephone or fax. When
the member requests the termination, subscription fees are NOT refunded.
Subscribers are liable for charges incurred by them until termination
of service. Should you choose to cancel your membership, please contact
webmaster@katies-world.com
stating you would like to cancel, including your username, password, email
address used when signing up, and your first and last name used when signing
up for the service. Failure to include the above-requested information will yield an unsuccessful result in membership cancellation, and the Webmaster of this site will wait for you to provide the above-required information.
7. REFUNDS
Refunds are ONLY issued if there is a billing error (such as a double-billing
occurance). If your card was used without your permission, please contact
your credit card company for a credit - one will NOT be issued by Ice
Blue Concepts, L.L.C. Should a refund be issued by Katies-World.com /
Ice Blue Concepts, L.L.C., all refunds will be credited to the credit
card used in the original transaction solely. Refunds will not be issued
by cash, check, or to another credit card. NO refunds are issued for private streaming webcam sessions.
8. Bookmarking
Subscriber
agrees that at any time they will not bookmark any page to the site that
will allow the subscriber to bypass the terms and conditions of the site
upon entering. If such a bookmark exists, said bookmark will constitute
full agreement to said terms and conditions as well as to admission that
subscriber is of legal age of majority in their state, country or region.
9. Authorization
of Use
Subscribers to the site are hear-by authorized a single license to download,
copy, or print material found on the site. This license shall granted
for sole use via one computer. All memberships are provided for personal
use and shall not be used for any commercial purposes or by any commercial
entities. Commercial use of either the site or any material found within
is strictly prohibited. No material within the site may be transferred
to any other person or entity, whether commercial or non-commercial. In
addition, materials may not be modified, or altered. Materials may not
be displayed publicly, or used for any rental, sale, or display. Materials
shall extend to copyright, trademarks, or other proprietary notices therefrom.
Katies-World.com / Ice Blue Concepts, L.L.C. reserve the right to terminate
this license at any time if the terms of this agreement are breached.
In the case that the terms are breached, you will be required to immediately
destroy any information or material printed, downloaded or otherwise copied
from the Site. We also reserve the right to disable your account if we
find your username to be abusing the system (i.e. your username logging
in from multiple IP Addresses). Katies-World.com reserves the right to contact the account holder via email, standard mail or phone should a discretion arise. Furthermore, if your username is logged
as abusing the system after you have requested to terminate your membership,
Katies-World.com / Ice Blue Concepts, L.L.C. reserve the right to charge
your card the full membership price for every additional IP Address that
accesses the memership area via your username/password combination. Katies-World.com reserves the right to terminate account holders for loggin in to chat sessions with an incorrect username, or for refusal to provide sufficient information regarding authorization to use said membership. Even
though your account may be disabled due to your username abusing the webcam
area, YOU are responsible for terminating your membership and ending the
recurring billing process (as prescribed in Section 6).
10. Transfer of
User Id
Access to the Site is through a combination of a username and a password
(UserId). Subscribers may not under any circumstances release their UserId
to any other person, and are required to keep his or her UserId strictly
confidential. Katies-World.com / Ice Blue Concepts, L.L.C. will not release
passwords for any reason, to anyone other than the Subscriber, except
as may be specifically required by law or court order. Unauthorized access
to the Site is a breach of this Agreement and a violation of law. Subscribers
acknowledge that the Webmaster of the site may track through the use of
special software each subscriber's entry to the site.
11. If any breach of security, theft or loss of UserId, or unauthorized
disclosure of UserId occurs, subscriber must immediately notify Katies-World.com
/ Ice Blue Concepts, L.L.C. of said security breach. Subscriber will remain
liable for unauthorized use of service until Katies-World.com / Ice Blue
Concepts, L.L.C. or the Site is notified of the security breach by email
or telephone.
12. Supplementary Terms and conditions
The Site may have additional Terms and Conditions that are an integral
part of this Agreement, and are in addition to these Terms and Conditions.
Such Terms and Conditions as listed at the Site will in no way invalidate
any of the Terms and Conditions listed here. All Terms listed apply to
Katies-World.com / Ice Blue Concepts, L.L.C. and the Subscriber. I agree
to the terms and conditions specified by the site linked to this page.
13. Severability
If any provision
of this Agreement shall be held to be invalid or unenforceable for any
reason, the remaining provisions shall continue to be valid and enforceable.
If a court finds that any of this Agreement is invalid or unenforceable,
but that by limiting such provision it would become valid or enforceable,
then such provision shall be deemed to be written, construed, and enforced
as so limited.
14. Notice
Notices by the Site to Subscribers may be given by means of electronic
messages through the Site, by a general posting on the Site, or by email
to the address provided by the User upon application for User ID.
